Shipped broken cpu, was it sellers fault?

Question

I got shipped a new cpu for my computer but when I opened the box the cpu was loose in the box but there was covering in the box so it looked like it fell out, the pins were also bent beyond belief

it mightve been their fault

It seller's fault.You supposed to receive it in good condition

if you received it damaged, even if seller shipped it new, it is up to him to pack it well.

he owes you a fefund (after you return it).
