That is, unfortunately, a hard lesson, but it's one that your daughter has to learn. When you receive money and literally GIVE it to someone else, why would you expect to get it back?
She can't claim money she gave away.

In the breaking news department, Steve Mnuchin has said there will be a web application for taxpayers who didn't use direct deposit. The app will allow people to provide their banking information to the IRS for purposes of direct depositing stimulus payments. If it can also be used for those who changed banks, perhaps your daughter can use it to prevent the boyfriend from getting the stimulus check.

She would have to take him to civil court. It's not a theft under common law because she willingly put it in her account but, unless she agreed to let him keep the money, it still is hers. Of course, if he tells a different story, it may be hard to win.

Expensive life lesson.
Most banks won't accept a direct deposit unless the person's name is on the account so it is interesting that the deposit was accepted if her name isn't on his account.
She willingly sent the money to that account. She could try small claims court but probably wouldn't win.

What a stupid thing to do. Trying to sue the guy is a waste of time. Kiss your money goodbye and learn how to pick better boyfriends.
