why in some cases the irs gives you your refund even if you owe child support?

is it a mistake from the irs or they do it once in a while. it has happen to me. i owe more than 5,000 in child support for 2 straight years the irs has given me my refund instead of taking it away.

    Because, obviously, no court has ordered it.  IRS doesn't withhold for child support without a court order to do so.

    The state must not have filed the offset.

    They only take the refund if the paperwork has been filed by the state to do so. Otherwise they have no way to know you owe.

    The state has to request it.

    Nothing prevents you from paying the amount down.

    my only guess is their computer was down this time. But 2 years in a row, maybe its a state not federal issue?
