Is it legal for a student to record another student in Indiana without their consent? ?

It was in the lunch room and they were recording very discretely off their iPhone. Also making fun of the kid.

    Indiana is a one-party consent law state. This means that in order to record the audio of a conversation, at least one person in that conversation has to consent to it being recorded.

    If the people doing the recording weren't part of the conversation (i.e. they were recording other people talking), then it would be illegal.

    Also, the school might have rules restricting where/when students are allowed to make recordings. These would vary from one school to the next, so you'd need to check with your school about what the rules are in such a situation. Violating the school's rules may not necessarily be illegal, but they could get you expelled or otherwise disciplined.

    In-person conversations do not appear to be covered by the law, but it cannot hurt to get consent before recording just in case.

    If with the intent of defamation, a law suite can be undertaken, if in certain other countries, it's against the law to do anything with the intention of defaming somebody. Somebody like the person you're pretending to be would likely be to stupid to know how they were found when they were found.

    There is no law that applies specifically to students and recording video. Generally speaking, you can video anyone in public. Public schools are actually private property, which means the school board and/or administration makes the rules about it. So whatever the school says, goes when it comes to recording inside the school.

    You can record in public, there is no expectation of privacy. It is really whether or not such a recording is admissible in court as opposed to the legality of the recording.

      Are you just guessing about Indiana laws or parroting  something authoritative?  Other states have very different laws. For example, under MA law, it is a felony to secretly record someone's voice in public without their consent.
