Does a child under 13 include 13 year olds?
a 19 year old I went to middle school with was just arrested last week for “raping a young girl under 13 years of age.” I wasn’t friends with him and no one I’ve asked seems to know much about the case, and the news report only offered that information. Not that it makes it any better, but does that mean the girl could have been 13, or was she 12 or younger?

Under 13 means 12 and under.

While it's a terrible thing to do to any age child. It sounds like the girl is 12 years old or younger.

It means that she has not had her 13th birthday. She could have turned 13 the next day. Or she could have been even younger.

The key word is "under." Think about it. If you are being paid under the minimum wage are you being paid the minimum wage or do you demand a raise?

It just means that the child who was raped is 13 or under. There is an enhancement in sentencing depending on the age of the child. Nothing to do with the actual age of the child.
