Legal? HR? ?

Is it legal for company to do a phone reference check with other individuals than the ones you provided them with?

    Not only legal but effective.  Most people only list the people that will give them a good reference. Asking those references for other names can get a more accurate picture.

    Perfectly legal.  They don't need your "permission" to contact whoever they wish.

    Sure. They can contact anyone they want to find out about you. When a company hires you as an employee, they're taking responsibility for your actions. They need to know what they're potentially getting themselves in for.

    If you want a good job, you have to be a fine and upstanding person. Someone who is shouldn't be afraid of potential employers contacting others for personal references.

    and how would they get that information?

    as long as they aren't doing anything illegal with the info, ANYONE can look you up through any means they like.
