Buy here pay here?

What happens when someone refuse to return a car back when they stopped paying for car at a buy here pay here. As an owner of the company can I have them arrested?

    You can have the car impounded in most states, and you need talk to your attorney about what to do.

    You can't have them arrested, but your tow guy can get the car eventually. They can't keep it locked up or hidden forever. What would be the point of that?

    You're not the owner. You're the debtor. 

    The owner of the lot would know the answer.

    It might possibly be theft by deception if the value of the car is less than what constitutes grand theft auto charges. So yes, arrest is possible.

    Always call police in these situations. Even if they can't legally do anything about it they will record the incident in a report that will help your situation if/when it goes to court to have.

    If you have a buy here pay here lot and somebody refuses to pay for the vehicle you called to have the vehicle repossessed. The police will only interfere if the person tries to hide the vehicle then you can charge them with secretion which is you're hiding the vehicle criminally to avoid repossession. If you're a legitimate buyhere payhere person you should know all about how to have a vehicle repossessed. What you can do is go get a writ of garnishment. And give it to the sheriff's department and let the sheriff's department seized the person's paycheck. You can also sue the person in a court of law to return the vehicle. And when they failed to do so you can have them arrested for contempt of court. In the meantime feel free to pursue your legal right of repossession where you have a company pick up the vehicle or pick it up yourself. You can also call the DMV tag office and have the tag suspended! Making it illegal for the person to have the vehicle on the road.

    There are no debtors prisons in the US.

    No, but you can send your repo guys out in the middle of the night to take the car back.
