Is a jaffa cake a biscuit or a cake?

This was decided many years ago when Her Majesty's Customs and Excise took McVitie's to a British VAT tribunal. Cakes are not taxable, but chocolate-coated biscuits are, and HMCE wanted some tax. After hearing all the arguments, the learned judge ruled that it's a cake.
So it's official. For tax purposes, Jaffa cakes are cakes.

Jaffa Cakes are biscuit-sized cakes
It's a delicious structure consisting of sponge, chocolate and orange jelly.

I believe that it was decided somewhere that it's a cake.
When a cake goes stale it becomes dry.
When a biscuit becomes stale it becomes moist and soft.
Jaffa cakes become dry.
