How can a boss report is worker to IRS if never gave them w 2 form file?

    Nobody gives their employer a W 2. You don't seem to get it - the employer gives one to YOU. Employers are REQUIRED to report employees to the IRS, by way of a W 2.

    You have it backwards. The employer must give the employee a W-2 at the end of the tax year. The employee must give the employer a W-4 when they first start the job.  If the employee did not fill out a W-4, you had two options. You could have fired them on the spot.  Or you could start withholding income tax at the single filer rate with 0 exemptions. You were required to immediately start tax withholding and making those payments to the government. If you did not, you are in trouble with the IRS, not the employee.

    This does happen. The employee that never filled out a W-4 sees how much tax is coming out and complains, and the employer says, 'If you had filled the W-4 out when I asked you, YOU could have controlled how much tax was coming out. You left me no choice.'  An employee can revise their W-4 at any time.

    The employer is legally obligated to put out the W2. They'd be foolish to report to the IRS without it.

    Who is "them"? The IRS or the worker? The company must file a W3 and W2s for the workers wages with the Social Security Administration. The SSA then reports the information to the IRS. The company is required to furnish the W2 to the employee by January 31. If the company did not file the required payroll reports and W2s, they are in big trouble.

    Why is the boss reporting the worker exactly?  An I-9 and W4 are required before starting work...

    Also, the employer provides the W2 to the employee...if you never got one, you can file with your paystubs...

    If you are asking about a W2 for 2019...they arent out yet...even if you are no longer working there.

    W2 are provided once a year.  They are required to be sent by January 31st to report the earnings of the prior year.

    Did you work there in 2018?  If so, you should tell your employer that you never received your W2 and need a replacement.
