Althorp was the property of her brother, Charles, 9th Earl of Spencer. According to some credible biographers, Diana asked to use property on the Althorp estate as her country home. Charles at first agreed, but when he found out about the security needed for this to happen, security that would have made it difficult for him to run his business at Althorp where it needed to be open to the paying public, backed out of the plan.
Diana always intended to keep Kensington as her London base . She and her sons needed a place in the city and during the separation, Kensington was given to Diana and the boys.

Her apartments at Kensington Palace was part of the divorce settlement. She couldn't live at Althorpe, for a number of reasons, her brother didn't want the papaRATzi camped outside the estate with all of the extra security and unwanted scrutiny, it was too much of an intrusion.

Her brother lives in the ancestral home.
At the time of her divorce it was decided that even though she would no longer be a HRH, (decided during negotiations confirmed by her mother in laws Letters Patent), she would remain part of the extended royal family as she was the mother of a future king.

She got all she could when negotiating the divorce settlement - including lifetime quarters at Kensington. That didn't last as long as she planned . . . . she didn't even have time to sell all the family jewels.

Ironically, it was to keep her safe. Plus it was felt that Prince William needed to live amongst royalty and protocol-aware servants in order to grow into a direct-line heir to the throne. Diana wasn't ever going to live at Althorp because she and her brother - who owned the estate - did not like each other.

Because it was the boys home , her old home was now her brother's, he did not want her to live with him, mainly because of all the added security that would be needed.

One assumes it had to do with the child custody arrangements.
