If you're having a nightmare and hit the person sleeping next to you in your dream is it assault?

    No. There was no intent to cause them harm, and whoever was sleeping was not being negligent either.

    Of course not -------  But I recommend that you sleep in separate beds from now on.  If the person goes to the other bed and hits you "while sleep walking"  then, I would not buy it.

    Only if the criminal justice system accepts your claim. This excuse has actually been used as defense for murder, if I remember correctly.

    I don't think so. Assault is a conscious, intentional act. Hitting someone while you are sleeping is not.
