Did this man commit a crime?

Gavin: One day he went to IHOP in the late evening hours, while Gavin was eating his meal there were a bunch of people fighting in the restaurant, he also even witnessed people throwing chairs, plates while they were throwing temper tantrums, when Gavin got done with his meal he just leaves his $20 bill on the table (the food he purchased was over $12) and walks out, he also left a note stating the waitress can keep the tip.

    he's not involved in the fight.

    he's just eating in the restaurant.

    when he left the bill in the restaurant, the extra change can be used as a tip.

    He did not commit any crime. The reasonable thing for any innocent bystander to do when a fight breaks out would be to get away as promptly and quietly as possible, "like the cat who stepped in the perfume".

    He would have been in danger if he had waited for his bill. Perhaps someone involved in the fight swiped his $20, but we'll never know.
