I m on social security and a credit card is suing me can they take my car it s a 95 pickup?

    Social Security cannot be garnished.

    Additionally, for credit card debt, they generally will not be able to get a judgement/lien on your primary residence or primary mode of transportation. Basically, they will end up paying a whole lot of legal fees only to not be able to collect - but you MUST show up for the hearings or risk the court giving the credit card company whatever they ask!

    Yes, the cc company can take your car, your home - any assets they want to, as well as garnisheeing your ss. Why haven't you been making payments toward your debt? Not doing so means at some point, you are going to be hit really hard, and you won't see it coming. Add court costs, penalties, interest and possibly attorney's fees to your debt. You may end up owing double.

    Yes they can if you’re not working. If you’re working and you need the car to get to and from work, you can declare bankruptcy and say that it’ll be hardship because you need the car for work.
