Can you get time served for a class A Misdemeanor ?

My husband turned himself in the day his warrant was issued and he's been in jail since March 25th of this year he goes to court on the 16th of this month and he was going to tell them that he pleads guilty could he get time served already since he's been in there for so long ?

Update:

also he is just a habitual traffic offender he was just driving with a suspended license

    It's possible, and depends on a lot of things. What was the crime? Was it a violent act? Does he have a record? Things like that matter in how the judge will decide to treat him.

    Yes, the time you are locked up before trial will count towards your overall sentencing

    You Yanks are amazing. In Australia he would be summonsed, not arrested, for a misdemeanour. ie he would get a letter in the post telling him to appear at court to answer the charge on such and such a date.

    And for a first, or even second offence, he wouldn’t get jail time even if he was found guilty. They would do fines first, then community service, and only as a last resort, jail.

    It’s like the cops over in America arrest anyone for anything. Here they only do it if the person is a risk of harm to himself or others, which is only a small minority of cases.

    Why so completely heavy-handed in the US?

    Depends on what it was. Depends on his past. Depends on a lot of things.

    Yes, but its up to the judge. Its best he gets his lawyer to make a deal with the prosecution instead of gambling with the judge.
