Is a current employer allowed to tell a potential employer (e.g. in a reference) how many sick days you had?

    In short, an employer can put anything they like, into a reference. The only requirement is that it MUST be the truth. Within this remit, any current employer can include anything which they feel is relevant, or have been asked about by the prospective employer..

    Yes they are allowed to tell them everything about you as an employee and they must tell the truth as if they dont they are liable if things do not work out and they decided to sue the other employer if they told them lies which could actually happen. I am an employer and tend to not give references to people of whom I could not give an excellent reference for then you know there will be no comeback.

    An employers reference has to give details of your employment, otherwise a future employer will have no use for it.

    Yes. In fact when asked for a reference it's something your employers will probably tell them without asking since its something that is fact and therefore they cannot be sued for telling them.

    potential employers do commonly inquire about attendance. they want to know that the potential employee isn't going to be calling in on a regular basis.

    They can put "facts" into a reference, they cannot put opinion.

    They have a duty (legal obligation) to be truthful.f

    Yes they can. They can say if they feel you are reliable or not.
