I know philosophical speculation can be a positive thing, but from my experience and the questions here it just seems like people thinking too much about their own internal struggles. A choice is only a choice if it is intended, and it is still a choice even if it fails to be successful. If I try to kill someone by shooting a bullet at them, that act alone says what kind of a person I am, regardless of whether I happen to hit or miss them. I'm not morally superior to someone who succeeds in killing, just because I happen to have a poor aim. There is also a huge difference in character between someone who attempts to save a drowning child and doesn't get there in time, and someone who just stands there and watches the child drown.

    Whatever consequence happens after the choice is made is out of the actor's control, so the actor can only be judged by his intention.

    If we judge by consequences alone, then we may as well call mountains evil for killing people with avalanches.

    "For example, backing over someone in your car."

    Assuming it was an accident, we can only say the driver was careless and reckless. Of course recklessness should still be punished.
