    What does this mean? I'm confused. Wife and I are filing jointly but her dad wants college tuition tax credit. He just wants the refund. Does this apply to him and would I still get my EIC, child tax credit? I'm pretty confused.

    I am going to file jointly with my wife on my taxes but her dad wants the college tax credit due to paying for her college for the last 4 years and I'm fine with that. However I am not going to file separately. Can I still file jointly and obtain the Earned Income Credit, Child Tax Credit for our 8 month old, and him get the college tax credit?

    My father in law is claiming my wife, who is 21 and who is a full time student, purely to get a refund from the college on his taxes.     My father in law is claiming my wife, who is 21 and who is a full time student, purely to get a refund from the college on his taxes. I was told that I could still file jointly with her but here's the problem. When I say that my wife is being claimed on someone else's tax return I am then told that I no longer qualify for Earned Income Credit and Child Tax Credit. I was also told that I couldn't even claim my 8 month old son! Before I said she would be claimed as a dependent on someone else's tax return I had $6,000. After I did this I now have $776. What's going on?
