IF U HAVE JOINT MORTGAGE CAN U TAKE THE RENT MONEY ON YOUR SOLE ACCOUNT?

i have a joint mortgage with my ex.We have a tenant.He pays the rent money my ex's account she pays the half of the mortgage and i pay rest of the mortgage.We have an agreement for it.I have all solicitor's letters from mine and her's solicitor it's saying the rental money goes to mortgage and i pay rest of it....

But she didnt put the rental money to mortgage company for last 2 months...

What can i do?

Can i sue her?cos its joint mortgage,my name is on the mortgage and i have solicitor's letter from both side.

If i sue her does she has to pay rentl money back??

If you sue and you win, yes she will have to pay the rent money back.

Advice.

Refinance under one name. Buy out your ex or have her buy you out.
You don't need the headache!

    So Sue wants to sue...her?

    First thing is to call her and find out why her part of the mortgage isn't being paid. You're both responsible for the entire mortgage, not half and half. That's just how you agreed to pay it.

    Then you can call your lawyer who will tell you what you can do. You can sue anyone if you have the filing fee, but whether or not you will win or just be wasting your money is a different story.
